These Terms & Conditions apply to services, coaching, assessments, digital products and other resources purchased from or provided by Flex Food Life.
By purchasing a service or product, commencing coaching or otherwise agreeing to these Terms, you agree to be bound by them.
Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law or other rights that cannot lawfully be excluded.
1. About Flex Food Life
Flex Food Life is operated by Maria Matina, a Nationally Recognised Nutritionist (NRN), registered with Nutrition Council Australia.
Flex Food Life provides nutrition coaching, personalised nutrition guidance, assessments and educational nutrition resources within Maria’s professional scope of practice.
Flex Food Life does not provide medical diagnosis or medical treatment and is not a substitute for care from a medical practitioner, Accredited Practising Dietitian or other appropriately qualified healthcare professional where this is required.
2. Eligibility and health information
FLEX Nutrition Coaching and personalised nutrition services are intended for adults aged 18 years and over unless otherwise agreed in writing.
You agree to provide information that is accurate and complete to the best of your knowledge, including relevant information about your health, medications, pregnancy status and other circumstances that may affect the suitability of nutrition advice.
You agree to notify Flex Food Life if relevant health information changes during coaching.
Where information you provide indicates that an issue may fall outside Maria’s professional scope, Flex Food Life may require medical clearance, referral or collaborative care before personalised nutrition advice begins or continues.
If coaching cannot safely proceed
If, following your initial health and nutrition assessment and before your weekly coaching begins, Flex Food Life determines that coaching cannot safely or appropriately be provided within professional scope, your weekly coaching subscription will not commence.
In this circumstance, the $149 FLEX Nutrition Coaching initial set-up payment will be refunded in full.
Where coaching may proceed once appropriate medical clearance or additional healthcare support has been obtained, we will discuss the available options with you before coaching begins.
3. FLEX Nutrition Coaching
FLEX Nutrition Coaching is a personalised online nutrition-coaching service.
Your strategy may include tools such as nutrition targets, meal structure, food tracking, macro guidance, meal planning, nutrition education, lifestyle tracking and other appropriate strategies depending on your individual needs.
The specific tools used may change throughout coaching as your goals, progress and circumstances change.
A meal plan, calorie target or macro target is not automatically provided to every client.
4. Initial set-up
FLEX Nutrition Coaching begins with a $149 initial set-up payment.
Your initial set-up includes:
a comprehensive nutrition assessment, review of your current intake and diet history, initial consultation, personalised starting strategy and coaching set-up.
The initial set-up payment is separate from your ongoing weekly coaching payments.
Change of mind before set-up work begins
If you change your mind before Flex Food Life has begun reviewing your assessment or carrying out your personalised set-up work, please contact maria@flexfoodlife.com as soon as possible.
If set-up work has not commenced, the initial set-up payment will be refunded.
Once personalised assessment review or set-up work has commenced, a change-of-mind refund is not generally available for work already performed.
This does not affect your rights under the Australian Consumer Law.
5. Weekly coaching and initial commitment
Ongoing FLEX Nutrition Coaching is $69 per week.
Your weekly coaching subscription begins on the coaching commencement date agreed with you during onboarding.
By commencing weekly coaching, you agree to an initial 8-week coaching period, consisting of eight weekly coaching payments.
The eight-week period is an initial coaching commitment, not a promise that a particular goal or result will be achieved within eight weeks.
Your individual progress through the FLEX Method will depend on your starting point, goals, participation and circumstances.
6. Continuing after the initial 8 weeks
After your initial eight-week coaching period, FLEX Nutrition Coaching continues on a rolling week-to-week basis unless cancelled.
You may cancel after completing your initial eight-week period by providing at least 7 days’ written notice to:
Cancellation will take effect seven days after your written notice is received. A weekly payment that falls due during that notice period may still be processed.
No further payments will be charged after the cancellation takes effect.
7. Ending coaching during the initial 8-week period
When you commence weekly coaching, you are committing to the initial eight-week coaching period.
If you choose to stop participating during this period purely because you have changed your mind, your initial eight-week payment commitment remains in place and coaching support will remain available to you for the remainder of that period.
If serious illness, injury or other significant circumstances mean you cannot reasonably continue, please contact Flex Food Life. Requests to pause or vary the remaining coaching period will be considered reasonably and in good faith based on the circumstances.
Nothing in this section limits rights or remedies available to you under the Australian Consumer Law.
8. Pausing coaching
Coaching pauses are not automatic and must be agreed with Flex Food Life.
Where a pause is agreed during the initial eight-week period, the remaining coaching weeks may resume after the pause rather than being cancelled.
If Flex Food Life is unable to provide coaching for a period due to illness or another circumstance within its control, you will not be charged for a period in which the contracted service is unavailable. Where appropriate, billing will be paused, rescheduled or an unused payment will be credited or refunded.
9. Weekly check-ins and participation
FLEX Nutrition Coaching includes a structured weekly check-in and ongoing support using the systems and communication channels outlined during onboarding.
You are encouraged to participate consistently so that coaching decisions can be based on useful information.
If you choose not to submit a weekly check-in, your coaching service and access to support remain available and the normal weekly fee continues to apply.
Unused check-ins do not automatically accumulate or convert to additional coaching weeks.
Support is primarily asynchronous and should not be relied upon for urgent or emergency medical assistance.
10. Payments
Payments are processed through Stripe or another payment provider nominated by Flex Food Life.
You authorise the relevant payment provider to process amounts that you have agreed to under the service you purchase.
You are responsible for ensuring your payment details remain current.
If a weekly payment fails, Flex Food Life may contact you and provide a reasonable opportunity to update your payment details.
If payment remains outstanding, coaching support may be paused until the account is brought up to date.
Flex Food Life will not charge for services that it is unable to provide.
All prices are stated in Australian dollars unless otherwise indicated. GST is included where applicable.
International clients may incur currency-conversion or financial-institution fees outside the control of Flex Food Life.
11. Build My Diet and other personalised one-off services
Personalised one-off services such as Build My Diet involve individual review and preparation work.
The inclusions and price of the service will be described at the time of purchase.
If you change your mind before personalised work has commenced, please contact Flex Food Life promptly.
Once personalised assessment, analysis, consultation preparation or other individual work has commenced, change-of-mind refunds are not generally available for work already performed.
This does not affect your rights under the Australian Consumer Law.
12. Digital products, meal plans and ebooks
Digital products are supplied for personal use only.
Once a digital product has been delivered, downloaded or made available for access, change-of-mind refunds are not generally available.
This does not affect your rights where a product is faulty, materially different from its description or otherwise fails to meet a consumer guarantee.
Meal plans, ebooks and other general digital resources are not individually tailored unless the product description expressly states otherwise.
Individual nutrition needs vary. If you have a medical condition, allergy, therapeutic dietary requirement, are pregnant or breastfeeding or require specialised nutrition care, seek appropriate professional advice before using a general meal plan or resource.
13. Australian Consumer Law
Our goods and services come with rights and guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded.
Where a service does not meet an applicable consumer guarantee, you may be entitled to a remedy depending on the circumstances.
Change-of-mind policies in these Terms do not affect your statutory consumer rights.
14. Client responsibilities
You remain responsible for your own decisions and participation in coaching.
You agree to:
provide accurate information, communicate relevant health changes, follow recommendations from your treating healthcare professionals, seek medical assistance where appropriate and use Flex Food Life services in a respectful and lawful way.
You should not disregard or delay seeking medical advice because of information provided through Flex Food Life.
Nutrition coaching is a collaborative process. Flex Food Life can provide guidance, education, feedback and accountability, but cannot control your actions outside coaching.
15. Results and outcomes
Flex Food Life does not guarantee a specific weight change, body-composition result, timeframe or health outcome.
Results vary between individuals and may be affected by factors including starting point, consistency, health, lifestyle, adherence, medication, training, sleep, stress and circumstances outside either party’s control.
Testimonials and previous client results are examples of individual experiences and do not guarantee that you will achieve the same outcome.
16. Communication and service boundaries
Your onboarding information will explain the normal communication and check-in process for your service.
Coaching support is not an emergency service and communication is not monitored continuously.
Calls, voice support or additional contact are included only where they form part of the purchased service or are otherwise agreed with Flex Food Life.
If you require urgent medical assistance, contact an appropriate healthcare provider or emergency service.
17. Intellectual property
Unless otherwise stated, all Flex Food Life materials remain the intellectual property of Flex Food Life.
This includes meal plans, recipes, ebooks, coaching resources, worksheets, educational materials, frameworks, the FLEX Method and other original content.
When you purchase a product or service, you receive a personal, non-exclusive and non-transferable right to use the materials for your own personal purposes.
You must not reproduce, resell, distribute, publish, share or commercially exploit Flex Food Life materials without prior written permission.
18. Privacy and health information
Flex Food Life handles personal and health information in accordance with its Privacy Policy and applicable privacy and health-record obligations.
The Flex Food Life Privacy Policy forms part of these Terms and is available at: flexfood.life/privacy-policy
Participation in coaching does not give Flex Food Life permission to publicly share your identity, progress photographs, health information, messages or testimonials.
Where Flex Food Life wishes to use client content for marketing or promotional purposes, separate consent will be sought.
19. Third-party services
Flex Food Life may use or recommend third-party platforms such as Stripe, Google services, Squarespace, MyFitnessPal and communication platforms.
These services are operated independently and may have their own terms, privacy policies and technical requirements.
Flex Food Life is not responsible for outages, changes or conduct of third-party services outside its reasonable control, although reasonable steps will be taken to minimise disruption to your coaching where possible.
20. Suspension or termination of services
Flex Food Life may suspend or terminate a service where there is a serious or repeated breach of these Terms, including significant non-payment, abusive or threatening behaviour, misuse of services or failure to disclose information necessary for services to be provided safely.
Where reasonably practicable, Flex Food Life will communicate the issue and provide an opportunity for it to be addressed before terminating the service.
If Flex Food Life ends coaching for reasons unrelated to a breach by you, no future coaching fees will be charged and any payment for coaching that will not be provided will be refunded or credited as appropriate.
After the initial eight-week FLEX Coaching period, either party may end the ongoing coaching arrangement by giving at least seven days’ written notice.
21. Changes to services, prices or these Terms
The Terms that apply to your purchase are the Terms made available to you when you enter into that agreement.
Flex Food Life may update these Terms for future purchases or future service periods.
Material changes will not be applied retrospectively in a way that removes existing rights or materially increases an existing client’s obligations without appropriate notice or agreement.
If the price of ongoing coaching is proposed to change after your initial commitment period, you will be given reasonable notice and may cancel before the new price takes effect.
22. Complaints and concerns
If you have a concern about a Flex Food Life product or service, please contact:
We will aim to address concerns fairly and within a reasonable timeframe.
Nothing in these Terms prevents you from exercising rights available under Australian law or contacting an appropriate consumer, privacy or health regulatory body.
23. Governing law
These Terms are governed by the laws of Victoria, Australia and applicable Commonwealth laws.
Where you live outside Australia, mandatory consumer protections that apply in your jurisdiction may also apply and are not excluded by these Terms where they cannot lawfully be excluded.
